Terms of Service

1. Agreement to Terms

By accessing or using MotusVoxPT ("the Service"), operated by DennTech Solutions and Services Limited ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

MotusVoxPT is a practice management platform designed for physiotherapists and physical therapy clinics. The Service includes voice-powered SOAP note generation, patient management, appointment scheduling, clinical documentation, and related tools.

3. Eligibility

The Service is intended for use by licensed healthcare professionals, specifically physiotherapists and physical therapists. By using the Service, you represent that you are a licensed healthcare professional in your jurisdiction and that your use of the Service complies with all applicable laws and regulations.

4. Account Registration

To use the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5. Clinical Data and Patient Information

You are solely responsible for the accuracy, completeness, and appropriateness of all clinical data, patient records, and notes entered into the Service. MotusVoxPT is a documentation tool and does not provide medical advice, diagnosis, or treatment. All clinical decisions remain the sole responsibility of the treating healthcare professional.

You agree to obtain all necessary patient consents before entering patient information into the Service and to comply with all applicable healthcare privacy laws and regulations, including but not limited to HIPAA (where applicable) and relevant local data protection legislation.

6. AI-Generated Content

The Service uses artificial intelligence to assist with SOAP note generation and clinical documentation. AI-generated content is provided as a drafting aid only. You are responsible for reviewing, editing, and verifying all AI-generated content before it is used in clinical practice or included in patient records. The Company makes no warranties regarding the accuracy or completeness of AI-generated content.

7. Subscription and Payment

Access to the Service requires a paid subscription. Subscription fees are billed in advance on a monthly or annual basis. All payments are processed by Paddle, our payment processor. By subscribing, you authorize us to charge your payment method for the applicable subscription fee.

Subscription fees are non-refundable except as described in our Refund Policy. We reserve the right to modify subscription pricing with 30 days notice to existing subscribers.

8. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Enter false or misleading patient information
• Attempt to gain unauthorized access to other accounts or systems
• Reverse engineer or attempt to extract source code from the Service
• Use the Service for any purpose other than legitimate clinical documentation

9. Data Security

We implement industry-standard security measures to protect your data. However, no method of transmission over the internet or electronic storage is 100% secure. You are responsible for maintaining appropriate security measures on your end, including strong passwords and secure devices.

10. Intellectual Property

The Service and its original content, features, and functionality are owned by DennTech Solutions and Services Limited and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of all patient data and clinical notes you create using the Service.

11. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. The Company's total liability shall not exceed the amount paid by you for the Service in the three months preceding the claim.

12. Termination

You may cancel your account at any time. We reserve the right to suspend or terminate your account if you violate these Terms. Upon termination, you may export your data for 30 days before it is permanently deleted.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes via email or through the Service. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by the laws of Jamaica. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Jamaica.
